W.Va. Code §4-2-4 established the powers and duties of the Legislative Auditor to: compile fiscal information for the Legislature; conduct audits and analysis of the state budget, revenues, and expenditures; conduct audits of the revenues and expenditures of state spending units; report any misapplication of state funds or erroneous, extravagant, or unlawful expenditures by any state spending unit; and to ascertain facts and make recommendations to the Legislature concerning audit findings, revenues and expenditures of the state, and the organization and function of the state and its spending units. These duties are fulfilled through the four divisions of the Legislative Auditor’s Office: the Performance Evaluation & Research Division, the Post Audit Division, the Budget Division, and the Regulatory & Fiscal Affairs Division.
